Rules for using the service

Terms of use

These terms set the responsibilities of ChamaClub, each chama and every person who uses the service.

Agreement and eligibility

By creating an account or using ChamaClub, you agree to these terms and the Privacy policy. You must be at least 18 years old and legally able to accept these terms. If you do not agree, do not use the service.

Authority to act for a chama

If you create a chama, accept an official role, change group settings, confirm records or act for a chama, you state that the chama has given you authority to do so. ChamaClub does not appoint officials or verify internal mandates. The chama must remove or change access when a person's authority ends.

What ChamaClub is and is not

ChamaClub provides software for keeping group records, payment evidence, approvals and decisions. ChamaClub is not a bank, SACCO, lender, payment provider, fund custodian, fiduciary, or adviser. It does not accept deposits, hold funds, issue loans, execute investments or guarantee returns.

ChamaClub does not provide tax advice, legal advice or investment advice. Your chama should obtain advice from a qualified professional where needed. Your chama chooses where members pay, who controls that destination, whether to approve a loan or investment, and how to carry out a decision. Records in the app do not replace bank, M-Pesa, contract, title, tax or regulatory records.

Accounts and account security

Provide accurate account information and keep access to your phone and device secure. Do not share codes, passwords or device credentials. Tell support@chamaclub.com if you suspect unauthorized access. The optional app lock uses your device security; ChamaClub does not hold or reset that credential.

Chama responsibility

Each chama is responsible for its constitution, membership decisions, officers, collection details, money, records, tax duties, licences and compliance with Kenyan law. Officials must review records before relying on them. Members must raise errors with the chama and ChamaClub without delay.

M-Pesa evidence and third parties

Members pay outside ChamaClub using collection details supplied by their chama. A pasted or optionally read M-Pesa message is evidence submitted by a member; it is not proof that ChamaClub received money. A member claim remains pending until an authorized treasurer confirms it.

M-Pesa, Safaricom, banks, investment providers, Firebase and other third parties operate under their own terms and systems. ChamaClub does not control their availability, transactions, fees, reversals or decisions. Verify important payment and investment information with the relevant provider.

Loans, guarantors, investments and votes

A loan request records requested terms and selected guarantors and then opens a group vote. A selected guarantor remains responsible only under the chama's own rules and any separate agreement; ChamaClub does not create or enforce a guarantee. An investment proposal also opens a vote and does not itself move money or purchase an asset.

Vote results are group records. The chama is responsible for quorum, authority, conflicts, legal documents and carrying out or reversing a decision.

Acceptable use

You must not use ChamaClub to break the law, deceive members, falsify payment evidence, impersonate another person, access another chama without permission, harass users, distribute malicious code, probe security controls, disrupt the service or use records for a purpose unrelated to the chama.

Uploads and group content

You own the content you provide and keep responsibility for text, ID photos, meeting details, financial evidence and other uploads. You confirm that you have the right and lawful reason to upload and share them. You give ChamaClub a non-exclusive, worldwide, royalty-free licence to host, copy, process and display that content only as needed to operate, secure and support the service. This licence ends when the content is deleted, except for retained records described in the Privacy policy or copies needed for legal and backup purposes.

Do not upload unlawful content or more personal information than the chama needs. ChamaClub may remove or restrict content that breaches these terms or creates a legal or security risk.

ChamaClub intellectual property

ChamaClub and its licensors own the service, software, website, brand, design and other intellectual property in ChamaClub, excluding content provided by users. Subject to these terms, ChamaClub gives you a limited, personal, non-exclusive, non-transferable, revocable licence to use the service for lawful chama activity. You may not copy, sell, sublicense, reverse engineer or create a competing service from ChamaClub except where the law does not allow that restriction.

Service changes and availability

ChamaClub is in early access. Features may change, fail or be withdrawn. We may perform maintenance, correct records affected by software faults and change technical providers. We will use reasonable care, but we do not promise uninterrupted or error-free access.

Suspension and termination

We may suspend or end access when reasonably needed to protect users, investigate misuse, comply with law, address non-payment for a future paid service, or stop a material breach of these terms. A chama may also remove a member under its own rules. Account deletion is described on the Delete account page.

Liability

Nothing in these terms excludes liability that cannot lawfully be excluded under Kenyan law. Subject to that rule, ChamaClub is not liable for funds sent to wrong details supplied by a chama, member or official misconduct, an external provider's act, investment loss, an unenforced loan or guarantee, or a decision made from inaccurate information entered by users.

Where ChamaClub is liable for a direct loss caused by our breach, liability will be limited to the amount paid to ChamaClub for the affected service during the six months before the event, or KES 10,000 if no fee was paid. This limit does not apply where Kenyan law prohibits it.

Notices and changes

We may send service notices through the app, this website or account contact details. You may send legal or support notices to support@chamaclub.com. We may update these terms for service or legal changes. Continued use after a notified effective date means the revised terms apply.

Disputes and Kenyan law

These terms are governed by Kenyan law. First send a written dispute to support@chamaclub.com with the account, chama and event involved. We will try to resolve it in good faith. If it is not resolved, the courts of Kenya have jurisdiction, subject to any consumer right to use another lawful forum.
